CEDR (the Centre for Effective Dispute Resolution) publishes a bi-annual report on the state of UK Civil and Commercial Mediation - and it makes good reading. The report showed that settlement at or soon after a mediation increased to a fantastic 93% - that is a sensational contribution towards saving time and money that would otherwise have been sent on fighting out the dispute through to trial. CEDR in fact estimates that the settled disputes saved as much as £4.6 billion. Not only is there a saving in time and money, but there remains an opportunity for parties to 'own' their settlement, even find common ground to resuscitate a commercial relationship, or rebuild a lost friendship. At the very least, it reduces the stress and anxiety of being in dispute.
If nothing else, the report demonstrates that mediation works. Comments are closed.
